Um . . . Spidy's not an orphan . . . Although I'll grant that he thought he was for most of his life.
He was an orphan. His parents were killed by Chameleon and The Finisher.
no they weren't don't know where you get your information…
Technically both Spidey and Superman were adopted.

verb (used with object)
to take and rear (the child of other parents) as one's own child, specifically by a formal legal act.
So, "technically" they were all orphans.
It always seemed that once one was adopted they were no longer an orphan. Batman's parents died and were never replaced hence orphan. Superman was found by a couple and raised as there own albeit illegally so adopted. Spider-Man was raised by immediate relatives the fact that his parents were gone didn't seem to add the orphan stigma to him.
Batman did have a legal guardian (Alfred) starting the moment when his parents died, so by your logic he wasn't an orphan either.
You can argue whether someone is still considered orphaned after being adopted all you want, but for this particular joke it works, they were all orphaned. They were all orphans. Regardless of your personal views of adoption.
