However I believe quantum dynamics (inability to measure speed and position of a subatomic particle) has made determinism on shaky ground? :)
Determinism isn't precluded by the uncertainty principle, only our ability to perfectly model the universe at time t, which would otherwise allow us to predict the state of the universe at time t + 1, aka, predict the future.
Either way, Daniel Dennett's "Freedom Evolves" has persuaded me to believe that determinism is fallacious, and that even if it wasn't, it wouldn't preclude free will.
At the end of the day, you have to feel in control. Feelings of powerlessness are toxic to mental health, and the justice system and our concept of responsibility hinge on our belief that we make choices.
That we don't actually make choices, though, should lead us to repaint the justice system as primarily a rehabilitative vehicle.

More importantly, a “predetermined” universe implies that someone of “free” will would have had to make all the decisions and plan a course of action for everything. And since “universe” is used as all-encompassing in this context, that is rather self-contradicting.

Mew? that’s not correct. Predetermined simply means mechanistic, in that the universe is like a machine which, once started, continues along a path determined by the fixed interactions of its constituent parts. Of course, as Fred says, this may not be the case :)
