the fact that Facebook change their TOS back so quickly is an indication that they knew they were wrong in the first place

Chris Brogan had an interesting post when the facebook TOS change originally came out. His argument boiled down to: "you already don't own anything". Companies that provide services for us have been selling our personal information for years. It's why we get telemarketing calls, credit card offers, and email spam. Privacy statements and anti-telemarketing laws are all reactive responses to this problem, not pro-active approaches to privacy.
Without weighing in on what our privacy rights should be, I'd just like to point out that some of Gen-X and almost all of Gen-Y have a completely different notion of privacy and personal transparency. I think facebook et. al. are just mirrors of a cultural shift we're undergoing, not drivers of that shift. In other words, there are large groups of people who could care less what happens to their content on facebook.

So do I own this comment, or do you?
