Very strange that you think having an under construction image up is not using the domain - it’s your perspective being pushed here. I don’t think what the owner wants to or is doing with the site is anyones business but his/hers. You really need to just offer them some cash and hope they accept.
In saying that is you have a registered company with the same name and can prove that usage of the domain name is causing your goodwill harm you can take them to court and have a forced change of ownership. I should know it’s happening to me right now

my daughter is a singing artist and I tried to register a domain for her earlier on and both the .com and .uk with her name in front has been taken, when I checked to see who by it is registered to a musician who offered her work recently (that could have made his music big in the industry) but she declined as she writes her own music anyhow.. so to spite us he has purchased both main url’s I would have used.. is there anything I can do about it? apart from find another name of course but this is just spiteful and ‘weird’

I wish I had thought to buy the google name, I’d be rich!
Of course, I now know what google is, to google something.
It’s now a household name and may be in websters.
My point is, come up with somthing new, you don’t need to worry about competition, he’s not doing anything with it.

Everyone has their price, I have some domains that I hope will be worth some bucks when all the dot com names are used up. Would I give them up because you cryed until I did? I don’t think so!
Give the guy a fair offer.

There is no way for you to know WHAT the guy may or may not be doing with his domain. He might be using it as a mail-only domain. He might be doing top-secret stuff with it that only those in-the-know can see, while everyone else sees the under-construction page. Regardless, I agree with most people that it’s wrong to try and take it from him.

I also think it’s wrong for corporations to bully people out of domains that they registered for their own purposes, under the pretext that they could cause copyright confusion and dilute their brand. I’ve been bullied out of a domain in the past that had very little to do with the company’s brand name, just because I didn’t think it was worth paying lawyers to defend.

Then trademark your business name.

The existing owner of the domain name will be in violation of a trademark act and you could commence a proceeding.

And since no other business name is already registered that reflects the domain name in the URI, your case is as good as gold.

If the guy doesn’t want give up the domain name, who are you to force him to? If he paid for it then it belongs to him. The man that lives across the street from me has a cherry red 68 Chevy SS…. In the five years I have lived here I have never seen him drive it. In fact it never leaves the garage. I would love to have the car. Does that mean I have the right to force him to hand it over to me? Of course not. Same thing just on a different level.

No, you should NOT be able to force the issue…….accept the fact and move on.

Sure you could use something else, but I agree that holding and not using this and all the other domains like that is plain greedy and stupid. It is annoying looking for a relevant, simple and easy for family to remember domain that is not available because some greedy idiot is sitting on it. I have often tried dozens of variations with no success.

I have to say, Mark, that you’re coming across like some spoiled child that want’s anothers toy. It’s not your toy. It’s his/hers. It can sit in the closet for years, but it’s still his/hers. Go find another toy to play with.

Don’t want to seem harsh, but you’re better then this I think.

Are all those here, who think the guy should hand over the domain, communists? Have you no respect for personal property? We have laws to protect that right in the U.S. It’s part of our bill of rights.

This is the same, exactly the same, as if you are my neighbor and you notice that my bike is just sitting there and I never ride it, so you ask if you can have it and I say no. Then you somehow think that you I must give you my bike, since I’m not using it at the moment. What if it’s a car sitting in my drive way, or what if I own a second home, you think you can just take that too?

I’ve got domains I’m not using at the moment. I hope you don’t want any of them.

Furthermore, you’re like stalking the guy. You have a relationship with him. He doesn’t have one with you. He doesn’t want to have anything to do with you. He doesn’t want to sell you the domain. Buy one with a different dot suffix, or stick a dash in the name, or get over it.

The whole debate is kinda creepy.
